Terms & Conditions

1. The “Organiser” is Cotswold Gliding Club, The Control Tower, Aston Down Airfield, Cowcombe Lane, Stroud, GL6 8HR.
2. These terms and conditions shall relate to the Aston Down Fireworks and Bonfire Night (the “Event”).
3. The “Venue” is Aston Down Airfield, Cowcombe Lane, Stroud, GL6 8HR.

 Tickets

4. By purchasing a ticket and/or attending the Event using a ticket (a “Ticket”), the Ticket holder agrees to be bound by the terms and conditions set out herein.
5. A valid Ticket entitles the holder to attend the Event on the relevant date as stated on the Ticket. There is no admittance to the event for any child under 18 years without an accompanying adult at any time.
6. There are 2 types of retail tickets, ‘car ticket (up to 5 people)’ and ‘car ticket (more than 5 people)’. The number of people specified in these ticket types shall include all members of the party, regardless of age.
7. Any promotional offers are for the ticket types described in (6). Promotional offers are at the Organiser’s discretion.
8. The Organiser has the right to refuse entry to late arrivals and no refunds for late arrival shall be granted.
9. Tickets shall not be resold, exchanged, or transferred. To do so, or to alter or deface any Ticket, will render it void.
10. Tickets can be printed or displayed on a smartphone.
11. It is the Ticket holder’s responsibility to check the date and venue of their Ticket, as mistakes cannot always be rectified. The Organiser shall not be responsible for any lost or stolen Tickets.
12. Tickets shall not be used as prizes in competitions without the prior written consent of the Organiser.
13. Accessible parking is available to Ticket holders who are blue badge holders. The Ticket holder should email events@cotswoldgliding.co.uk to make the team aware that an accessible space is needed. A blue badge must be displayed.
14. Tickets can only be purchased online in advance through the event website www.astondownevents.co.uk. Tickets purchased on other ticketing platforms are not official and will not be valid.
15. No tickets available on the door.

Refunds

16. Orders of Tickets may be cancelled or exchanged provided that this occurs within 2 working days after purchase. After this time all tickets are non-refundable.
17. All requests for cancellations or changes should be made by emailing events@cotswoldgliding.co.uk. 
18. No refund shall be made if the Ticket holder is late, refused entry, evicted from the Event, unable to attend, or has purchased an incorrect ticket.
19. Tickets are sold subject to the Organiser’s right to alter or vary the programme due to events or circumstances beyond their control, without being obliged to refund monies or exchange Tickets.
20. Should the Event be postponed, a Ticket holder may be refunded if they are no longer able to attend the Event on a new date, however no additional expenditure incurred by the Ticket holder shall be refunded to the Ticket holder. 
21. Should the Event be cancelled by the Organiser, the Ticket holder may be entitled to a full refund of the Ticket price, but no refund shall be given in respect to any other expenditure whatsoever. Ticket refunds may be claimed for up to 30 days after the cancelled Event. If the Event is cancelled due to Force Majeure, no refund of the Ticket price or any additional expenditure shall be refunded to the Ticket holder.
22. For the purposes of these Terms and Conditions, “Force Majeure” means any cause beyond the Organiser’s control including, without limitation, an act of God, war, insurrection, riot, civil disturbances, acts of terrorism (or the threat thereof), fire, explosion, flood, royal mourning, national mourning, theft of essential equipment, malicious damage, strike, lock out, storm, torrential downpour, third party injunction, national defence requirements and/or acts of national or local governments. The Organiser shall not be liable for failure to perform any obligation under these Terms and Conditions to the extent that the failure is caused by Force Majeure.
23. Occasionally, inclement weather can disrupt an open-air event. Any decision to cancel the Event shall be taken by the Organiser. No refund shall be made if the Event starts, but is later abandoned.
24. On entry, the Ticket holder agrees to accept and abide by any Event rules of the Organiser and any other regulations provided on entry to the Event.

Void Tickets, Refusal of Entry, and Ejection

25. The Organiser operates the ‘Challenge 25’ policy with regard to the purchase of alcohol.
26. Any breach of the Terms and Conditions shall render the Ticket void and result in refusal of entry to the Event, or ejection from the Event. The Organiser reserves the right to conduct security searches to ensure the safety of visitors and refuse admission to any Ticket holder who is deemed to be a risk to the safety of visitors. 
27. The Organiser shall be entitled to request removal of anyone from the Event who is under the influence of drugs or alcohol or who, in the reasonable opinion of the Organiser, is conducting themselves in a manner unconducive to their continued attendance at the Event. Any Ticket holder removed from the Event shall not be readmitted. 
28. Re-entry to the Event shall only be permitted at the Organiser’s entire discretion.

 Conditions of Entry

29. There is no admittance to the Event after 17:30 hours on the day of the Event.
30. No alcohol shall be brought onsite. Without exception, no glass bottles or other glass items shall be brought onsite.
31. Smoking (including vaping) is only allowed in outdoor areas, and is not allowed in any structure (including temporary structures) at the Event, or within 10 metres of any aircraft. 
32. All litter must be placed in appropriate bins and not dropped as this presents a hazard to aircraft.
33. Prohibited items:
    1. No alcohol
    2. No drones or other flying objects
    3. No glass bottles or other glass items
    4. No flags
    5. No fireworks/pyrotechnics, flares/distress flares
    6. No sparklers
    7. No weapons or tools
    8. No air horns, flares, lasers, smoke devices, spray cans or cannisters
    9. No hand-held communication devices such as radios, radio jammers/scanners 
    10. No unauthorised tabards and reflective/high-vis jackets
    11. No scooters or skateboards
    12. No illegal substances (drugs) and legal highs, herbal highs, new psychoactive substances and unidentifiable substances – including Nitrous Oxide
    13. No sound systems (including personal speakers)
    14. No unauthorised solicitation or marketing materials (e.g., handbills, flyers, stickers)
    15. No unauthorised musical instruments: trumpets, drums and other devices capable of causing a disturbance or nuisance
    16. No items that could be hawked or sold without prior permission from the Organiser
34. All sound and moving or still picture rights including, without limitation, on the internet, vest exclusively with the Organiser and any material filmed or recorded at the Event shall only be used for the personal, non-profit making enjoyment of amateurs. By entering the Event, Ticket holders consent to being photographed, filmed, or recorded as visitors attending the Event, and for their likeness, mannerisms and/or voice to be included in any content from such filming, photographs and/or recording (and edited) without compensation and/or credit, which content may be communicated and/or exploited in any and all media worldwide in all perpetuity.
35. The Organiser, its contractors or agents, shall not be liable for any loss, injury or damage howsoever caused to the bearer of a Ticket, save for death or personal injury caused by the negligence of the Organiser, its contractors or agents or any other liabilities that cannot be excluded by law.
36. Ticket Holders should keep their personal belongings with them at all times and the Organiser accepts no liability for damage to, or loss (including theft) of, personal belongings or vehicles while on or at the venue.
37. Please note that prolonged exposure to loud noise may cause damage to hearing. Please be aware that strobe lighting may be used during certain activities during the Event.

Data Protection

38. The Ticket holder acknowledges that in connection with purchasing tickets for or attending the Event, the Ticket holder will provide the Organiser with certain personal data, such as their name and contact details.
39. The Organiser is committed to ensuring that personal data is stored securely and in compliance with applicable data protection regulations. Personal data will be stored and processed in accordance with the Organiser’s data protection policy.
40. The Organiser’s privacy notice is available at www.cotswoldgliding.co.uk/privacy-policy. The full data protection policy may be requested via email to events@cotswoldgliding.co.uk.

Severability and Variation

41. The Organiser reserves the right to amend these Terms and Conditions from time to time when deemed reasonable and necessary to do so. Ticket holders are responsible for checking the Terms and Conditions that apply to the Event. The Organiser shall make all reasonable endeavours to put an alert on the Event website www.astondownevents.co.uk if the Terms and Conditions have been amended.
42. If any part of this agreement is declared unenforceable or invalid, the remainder of the Terms and Conditions shall continue to be valid and enforceable.
43. These Terms and Conditions shall be governed by English law and those bound by them hereby submit to the exclusive jurisdiction of the English courts in connection herewith.
